Pertaining to four easements for public water mains granted by Pulte Homes of Minnesota LLC and Project Paul, LLC on property located at the Highland Bridge Redevelopment Site in the city of Saint Paul.



Body
WHEREAS, Pulte Homes of Minnesota LLC (“Pulte Homes”) and Project Paul, LLC (“Project Paul”) are owners of certain real property within the development site known as Highland Bridge in the city of Saint Paul; and

WHEREAS, Pulte Homes is constructing rowhomes along the westerly side of Woodlawn Avenue and Project Paul is selling lots along the easterly side of Mississippi River Boulevard for the construction of detached single-family homes; and

WHEREAS, these areas of construction will have a shared alleyway constructed between them which will have public water main available to the residents on either side of the alleyway; and

WHEREAS, this location of water main reduces future maintenance costs to the Board compared to installing water main in both Woodlawn Avenue and Mississippi River Boulevard; and

WHEREAS, construction such as this is planned along four blocks within the southwesterly area of Highland Bridge; and

WHEREAS, within each of these alleyways, Pulte Homes is willing to dedicate a twenty-foot wide strip and Project Paul is willing to dedicate an adjacent ten-foot strip of the alleyway for a total of 30 feet in complete width for the dedication of public water main easements which grant the Board of Water Commissioners of the City of Saint Paul perpetual easement rights over, under, across, and through the said 30 foot strips for public water main purposes; and

WHEREAS, the Attorney’s Office of the City of Saint Paul has prepared a Municipal Utility and Water Services Agreement which accomplishes such dedication of easement rights; now, therefore, be it
