Authorizing the Police Department to partner with Aitkin County Sheriff’s Office to donate its used personal protective gear (hereinafter referred to as “protective gear”).

WHEREAS, the Saint Paul Police Department is seeking to partner with Aitkin County Sherriff’s Office to donate protective gear to local agencies that do not currently have personal protective gear for their mobile field force teams; and
WHEREAS, the Saint Paul Police Department has collected this protective gear which is comprised of non-ballistic helmets, chest protectors and shin guards; and
WHEREAS, this protective gear has been decontaminated in accordance with COVID guidelines and is contained in COVID appropriate containers and available to be shipped as Aitkin County Sherriff’s Office deems appropriate; and
WHEREAS, Aitkin County Sherriff’s Office, and all local agencies accepting this protective gear, accept it “as is”, with all of its faults, and without any warranty or guarantee from the Saint Paul Police Department, the City of Saint Paul, its employees, agents, representatives or assigns that this protective gear is suitable for its intended use; and
WHEREAS, Aitkin County Sherriff’s Office, and all local agencies accepting this protective gear, acknowledges that neither the Saint Paul Police Department, the City of Saint Paul, its employees, agents, representatives or assigns have made any representation in writing or orally that the protective gear is suitable for its intended use; and
WHEREAS, Aitkin County Sherriff’s Office and all local agencies by accepting this protective gear, hereby waive all claims, liability and damages against the Saint Paul Police Department, the City of Saint Paul, its employees, agents, representatives or assigns attributable to their possession, use or otherwise of the protective gear; and
WHEREAS, the Aitkin County Sherriff’s Office will handle requests for protective gear from other agencies and coordinate delivery; a...
