Title

Appeal of Najia Walker, Arcade Trust, to a Fire Inspection Correction Notice (which includes condemnation) at 928 ARCADE STREET.

 

Date/Time of 1st LH:  Tuesday, February 23, 2021, teleconference hearing between 11:30 a.m. and 1:00 p.m.

Purpose of Appeal:  Red shingles on south side of building are visible from the street. The rest of the shingles still have snow on them and it can't be seen if they are worn or defective. It is also a problem with the winter weather to get a contractor to bid this job. The COVID-19 problem is also making it hard to get this work completed in the time given. There is now damage to the interior of the building because of Item 4, SPLC 34.09(2). At this time, Arcade Trust would ask for an appeal or a waiver of this item until weather permits this item to be addressed. Thank you. (paraphrased)

Legislative Hearing Staff Comments:  Appellant included a deficiency list dated January 21 with a reinspection the next day. Appellant said there is an updated deficieny list and staff found one dated January 22. Appellant is not appealing Item 26, which is the condemnation item. He said that has been fixed.

WHEREAS, in the matter of the Appeal of Najia Walker, Arcade Trust, to a Fire Inspection Correction Notice (which includes condemnation) at 928 ARCADE STREET, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

 

WHEREAS, the Legislative Hearing Officer recommends that the City Council grant to April 9, 2021 for compliance with orders and Item number 26 of orders is withdrawn by Dept of Safety and Inspections; Now, Therefore, Be It

 

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
