Pertaining to a Sixteenth Rider to Agreement with the Ramsey County Board of Commissioners to allow construction of a detention pond at the Board’s Saint Anthony Park Pump Station.

WHEREAS, an Agreement between the Board of County Commissioners of Ramsey County (“County”) and the Board of Water Commissioners of the City of Saint Paul (“Board”) dated June 6, 1966 provided permission for the County to enter upon Board property to carry out necessary operations in respect of certain County improvements; and
WHEREAS, the Board is owner of a parcel in the SE quarter of the SE quarter of Section 20, Township 29 North, Range 23 West, Ramsey County, Minnesota, Property Identification Number 20.29.23.44.0122, commonly known as the Saint Anthony Park Pump Station, (the “Premises”); and
WHEREAS, at this time the County desires permission to construct a stormwater BMP detention pond in the southwesterly portion of the Premises in accordance with Ramsey County Project No. P-3399, the reconstruction of Cleveland Avenue from Como to Larpenteur; and
WHEREAS, the Board is willing to grant said permission, consistent with the requirements and safety of the works of the Board; and
WHEREAS, staff has prepared a Sixteenth Rider to Agreement which grants permission for said activities, and which protects the Board’s rights, interests and facilities, and the assistant city attorney has approved it as to form; now, therefore, be it
RESOLVED, that the Board of Water Commissioners of the City of Saint Paul does hereby approve the Sixteenth Rider to Agreement with the Board of Commissioners of Ramsey County in substantially the form submitted, and that the proper officers are hereby directed and authorized to execute said Rider on behalf of the Board.
