Pertaining to MnDOT Agreement No. 1044672 with the State of Minnesota providing for the relocation of one hydrant in conjunction with State Project No. 6282-231.

WHEREAS, the State of Minnesota, acting by and through its Commissioner of Transportation (the “State”) intends to let a contract for State Project No. 6282-231 located on Trunk Highway 94 from MN 280 to 0.1 mile west of Western Avenue in the City of Saint Paul; and
WHEREAS, the Board of Water Commissioners of the City of Saint Paul (the “Board”) owns and operates certain water facilities presently located within the limits of said project; and
WHEREAS, the State has determined that relocation of one of the Board’s hydrants within the project area is necessary due to its conflict with planned sidewalk improvements, and that Minnesota Statutes provide for this relocation work to be accomplished as part of a state highway construction contract; and
WHEREAS, the State prepared Agreement No. 1044672 to provide for reimbursement of said relocation work at a cost not to exceed of $11,207.97; and
WHEREAS, staff has reviewed said agreement and recommends approval; now, therefore, be it
RESOLVED, that Agreement No. 1044672 between the Board of Water Commissioners of the City of Saint Paul and the State of Minnesota pertaining to the relocation of one hydrant within State Project No. 6282-231 located on Trunk Highway 94 from MN 280 to 0.1 mile west of Western Avenue in the City of Saint Paul is hereby approved in substantially the form submitted, and that the proper officers are hereby authorized and directed to execute said agreement on behalf of the Board, following approval of the assistant city attorney.
