Title

Approving the application with conditions, per the Deputy Legislative Hearing Officer, for The Green Mill Inn LLC, d/b/a Green Mill (License ID # 20130005371), to modify the existing conditions to permit the expansion of bar seating at 57 Hamline Avenue South.

 

Body

WHEREAS, The Green Mill Inn LLC, d/b/a Green Mill (License ID # 20130005371), located at 57 Hamline Avenue South, has requested modification of the existing license conditions to remove restrictions on the hours when hard liquor may be sold, the method of sale for hard liquor, and to permit the expansion of bar seating; and

 

WHEREAS, objections to the request to modify the existing license conditions to remove restrictions on the hours when hard liquor may be sold, the method of sale for hard liquor, and to permit the expansion of bar seating were received within the notification period; and

 

WHEREAS, after meeting with neighbors, the licensee submitted a new request asking that the existing conditions be modified only to allow the expansion of bar seating, and withdrawing the request to remove restrictions on the hours and method of sale for hard liquor; and

 

WHEREAS a hearing was held by telephone or other electric means on April 9, 2020; and

 

WHEREAS, after conducting the hearing and considering the testimony and evidence, the Deputy Legislative Hearing Officer recommends that the application to modify the existing conditions to permit the expansion of bar seating for The Green Mill Inn LLC, d/b/a Green Mill (License ID # 20130005371), at 57 Hamline Avenue South, be approved with the following conditions:

 

1.                     Sale of alcoholic beverages should be limited to 30% of total sales. Green Mill will continue to utilize all of its tables for full menu service.

2.                     Hard liquor service will terminate with the closing of the kitchen at 11pm on weekdays and midnight on weekends.

3.                     No Happy Hour specials on hard liquor drinks.

4.                     No entertainment requiring a Class B license is allowed.

5.                     A Designated Driver Program will continue to be promoted within the restaurant.

6.                     No dumping of glass and bottles into dumpsters by Green Mill cleanup staff before 7am and after 10pm.

7.                     No pickup of trash and/or recyclables before 7am on weekdays or 9am on weekends.

8.                     Customers will not be seated at the outdoor sidewalk café after 8:30 PM and this outdoor café will be closed (unoccupied) at 9:30 PM.

9.                     Each year prior to the placement of table(s) and/or chair(s) in the public right-of-way (i.e., sidewalk), the licensee agrees to obtain a new Obstruction Permit from the Department of Public Works. Licensee agrees to maintain the sidewalk café in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective on April 1 and expires on October 31 of each year, that table(s) and/or chair(s) may not be placed in the public right-of-way before or after the effective/expiration dates, and that a failure to comply with this condition will result in adverse action being taken against all of their licenses.

10.                     Failure to comply with any of these conditions may be grounds for adverse action.

11.                     Sidewalk seating is approved for a maximum of thirty-six (36) seats.

 

THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves the licensee's request to modify existing conditions permitting the expansion of bar seating with the aforementioned agreed-upon conditions.

 

The conditions affidavit was signed and submitted on April 9, 2020.
