Approving a waiver of the 45-day notice requirement to add a Liquor Outdoor Service Area (Patio) license and expand the indoor liquor service area by approximately 1,700 square feet in size for a business with the following existing licenses: Liquor On Sale - 181-290 seats, Liquor On Sale - 2AM Closing, Liquor On Sale - Sunday, Liquor Outdoor Service Area (Sidewalk), Entertainment (B), Gambling Location, and Shared Parking Agreement licenses with conditions to Meefy Beat Inc., d/b/a Shamrock’s Irish Nook (License ID #20060004156) at 995 7th Street West.

Body

WHEREAS, Meefy Beat Inc. d/b/a Shamrock’s Irish Nook (License ID #20060004156) applied to add a Liquor Outdoor Service Area (Patio) license and expand the indoor liquor service area by approximately 1,700 square feet in size for a business with the following existing licenses: Liquor On Sale- 181-290 seats, Liquor On Sale- 2AM Closing, Liquor On Sale- Sunday, Liquor- Outdoor Service Area (Sidewalk), Entertainment (B), Gambling Location, and Shared Parking Agreement Licenses for the premises located at 995 7th Street West; and  

 

WHEREAS, the licensee requested a waiver of the 45-day notification waiting period for approval of the above-mentioned licenses; and

 

WHEREAS, the Department of Safety and Inspections received a letter from the West 7th/Ford Road Federation on January 15, 2020 in support of a waiver of the 45-day notice requirement and approval to add a Liquor Outdoor Service Area (Patio) license and expand the indoor liquor service area by approximately 1,700 square feet in size for a business with the following existing licenses: Liquor On Sale- 181-290 seats, Liquor On Sale- 2AM Closing, Liquor On Sale- Sunday, Liquor- Outdoor Service Area (Sidewalk), Entertainment (B), Gambling Location, and Shared Parking Agreement License; and

 

WHEREAS, the Department of Safety and Inspections received no objections to the waiver of the 45-day notice requirement and approval to add a Liquor Outdoor Service Area (Patio) license and expand the indoor liquor service area by approximately 1,700 square feet in size for a business with the following existing licenses: Liquor On Sale- 181-290 seats, Liquor On Sale- 2AM Closing, Liquor On Sale- Sunday, Liquor- Outdoor Service Area (Sidewalk), Entertainment (B), Gambling Location, and Shared Parking Agreement Licenses; and

 

WHEREAS, the Council finds that the application is in order and there are no grounds for denial of a waiver of the 45-day notice requirement and approval of the licenses; now, therefore, be it,

 

RESOLVED, a waiver of the 45-day notice requirement is granted to add a Liquor Outdoor Service Area (Patio) license and expand the indoor liquor service area by approximately 1,700 square feet in size for a business with the following existing licenses: Liquor On Sale- 181-290 seats, Liquor On Sale- 2AM Closing, Liquor On Sale- Sunday, Liquor- Outdoor Service Area (Sidewalk), Entertainment (B), Gambling Location, and Shared Parking Agreement License are hereby approved and issued to Meefy Beat Inc. d/b/a Shamrock’s Irish Nook (License ID #20060004156) for the premises located at 995 7th Street West in Saint Paul with the following conditions:

 

SIDEWALK SEATING:  APPROVED FOR MAXIMUM 16 SEATS

 

1.  Each year prior to the placement of table(s) and/or chair(s) in the public right-of-way (i.e., sidewalk), the licensee agrees to obtain a new Obstruction Permit from the Department of Public Works.  Licensee agrees to maintain the sidewalk café in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective on April 1 and expires on October 31 of each year, that table(s) and/or chair(s) may not be placed in the public right-of-way before or after the effective/expiration dates, and that a failure to comply with this condition will result in adverse action being taken against all of their licenses.

 

2.  No outdoor food and/or beverage preparation is allowed on a public sidewalk without prior approval and additional licensing from DSI.

 

03/08/2010 10-011174 BZA approved the provisions of the zoning code to allow a parking variance of 32 parking spaces, a west property line setback of zero (0), and a minimum area of landscaping of 5.7% in order to enlarge Shamrocks Bar and Restaurant and establish a new parking lot at 995 7th Street West; subject to the following conditions:   1) That the applicant obtain a shared parking agreement or otherwise provide an additional 16 parking spaces within the next year, and 2) That the parcels are combined under a single tax identification
