Title

Authorizing the City of Saint Paul to apply for and execute a Limited Use Permit with the State of Minnesota, Department of Transportation for a shared use trail within the right-of-way of Trunk Highway 5 and in the right-of-way of Interstate 94.

 

Body

WHEREAS , the City of St. Paul is a political subdivision, organized and existing under the laws of the State of Minnesota; and

 

WHEREAS, the City Council of the City of St. Paul has approved a plan to construct a non-motorized pedestrian and bicycle trail in the right-of way of Trunk Highway 5 and in the right-of-way of Interstate 94 to promote the orderly and safe crossing of the highways; and

 

WHEREAS, the State of Minnesota, Department of Transportation (MnDOT) requires a Limited Use Permit for the construction and utilization of said pedestrian and bicycle trail;

 

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of St. Paul hereby authorizes the appropriate city officials to apply for a Limited Use Permit with MnDOT to construct, operate and maintain a non-motorized recreational trail within the right-of--way of Trunk Highway 5 and under the Interstate 94 Johnson Parkway Bridge; right-of-way owned by the State of Minnesota, in accordance with the Limited Use Permit granted by MnDOT; and

 

BE IT FINALLY RESOLVED, that the Public Works Director or the City Engineer are authorized to execute the Limited Use Permit and any amendments to the Permit.
