Authorizing the City of Saint Paul to enter into a Cooperative Agreement with Ramsey County regarding the replacement of a traffic signal at Lexington Parkway and St. Clair Avenue.
Body
WHEREAS, the City of Saint Paul had a project to construct a traffic signal system at the intersection of Lexington Parkway and St. Clair Avenue; and
WHEREAS, the City provided all engineering, labor, materials and equipment for this project; and
WHEREAS, Ramsey County has agreed to provide payment to the City for the County's share of the costs of the project in accordance with the Ramsey County Cost Participation Policy as stated in the agreement; and
WHEREAS, the City shall continue to be responsible for maintenance of the traffic signal systems as outlined in the agreement; and
WHEREAS, the agreement provides for cross indemnification, with the City indemnifying the County for its own acts and omissions; and
WHEREAS, the City Council finds that there is a public purpose for the indemnification because the project increased traffic safety at the Lexington/Saint Clair intersection; now, therefore, be it
RESOLVED, that the Mayor and the proper City Officials are hereby authorized and directed for and on behalf of the City to enter into Ramsey County Agreement No. PW2019-19, a copy of which is before Council and is made a part hereof; and be it
FINALLY RESOLVED, that the Mayor and the proper City Officials are authorized to execute the Agreement and any amendments to the Agreement.
