Approving a waiver of the 45-day notice requirement to issue Malt On Sale (Strong) and Wine On Sale licenses with conditions to Firebox Company LLC, d/b/a Firebox (License ID #20190002618) at 1585 Marshall Avenue.

WHEREAS, Firebox Company LLC d/b/a Firebox (License ID #20190002618) applied for a Malt On Sale (Strong) and Wine On Sale License for the premises located at 1585 Marshall Avenue; and
WHEREAS, the licensee requested a waiver of the 45-day notification waiting period for approval of the above-mentioned licenses; and
WHEREAS, the Department of Safety and Inspections received a letter from the Union Park District Council on September 10, 2019 in support of a waiver of the 45-day notice requirement and approval of the Malt On Sale (Strong) and Wine On Sale Licenses; and
WHEREAS, the Department of Safety and Inspections received no objections to the waiver of the 45-day notice requirement and approval of the Malt On Sale (Strong) and Wine On Sale Licenses; and
WHEREAS, the Council finds that the application is in order and there are no grounds for denial of a waiver of the 45-day notice requirement and approval of the licenses; now, therefore, be it,
RESOLVED, a waiver of the 45-day notice requirement is granted and a Malt On Sale (Strong) and Wine On Sale License are hereby approved and issued to Firebox Company LLC d/b/a Firebox (License ID #20190002618) for the premises located at 1585 Marshall Avenue in Saint Paul with the following conditions:
CONDITION #1 PER ZONING VARIANCE #18-118951:
1. A decorative fence with a minimum height of forty-two (42) inches shall be installed along the south property line per Section 63.314(b) of the Zoning Code and the approved site plan.
