Approving adverse action against the Cigarette/Tobacco license held by Carter’s Oil and Food, d/b/a Carter’s BP (License ID #20060003657) at 623 Como Avenue.

WHEREAS, the Cigarette/Tobacco license held by Carter’s Oil and Food d/b/a Carter’s BP (License ID #20060003657) for the premises located at 623 Como Avenue in Saint Paul was the subject of a Notice of Violation sent June 20, 2019; and
WHEREAS, the Notice stated that during a Cigarette/tobacco and price compliance check on April 23, 2019, a DSI Inspector observed Juicy Double Wraps and Double Platinum Up & Up Blunts Wraps (vanilla) in violation of Saint Paul Legislative Code § 324.07 (f); and
WHEREAS, per Saint Paul Legislative Code § 310.05 (m) (2), the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, the licensee did respond to the Notice of Violation with questions of a payment plan but did not choose the four (4) options available to him and failed to follow-up to either pay the $500.00 matrix penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a public or administrative hearing by July 5, 2019, that the matter would be placed on the next available consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Carter’s Oil and Food d/b/a Carter’s BP (License ID #20060003657) for the premises located at 623 Como Avenue is hereby ordered to pay a $500.00 matrix penalty for the Juicy Double Wraps and Double Platinum Up & Up Blunts Wraps (vanilla).
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
