Pertaining to a Tenth Rider to an Agreement between the City of Spring Lake Park and the Board, to allow construction of a multi-use pathway for non-motorized purposes.

WHEREAS, The Board of Water Commissioners does possess certain right-of-way easements containing the Board’s two 60-inch Mississippi River Conduits in the south one-half of Section 1, Township 30 North, Range 24 West, in Anoka County; and
WHEREAS, The City of Spring Lake Park having entered into an Agreement with the Board of Water Commissioners dated June 30, 1961, for the purposes of locating certain public works within the Board’s right-of-way in the City of Spring Lake Park; and
WHEREAS, The City of Spring Lake Park desires to construct a multi-use pathway for non-motorized purposes within said easement, along the northern boulevard of Osborne Road Northeast (Anoka County Road 8) from State Trunk Highway 65 to Anoka County CSAH 35; and
WHEREAS, Staff has prepared a Tenth Rider to that Agreement of June 30, 1961, which sets forth the conditions of construction and access over the Board’s right-of-way, and said Agreement protects the Board’s rights, interests, and facilities and staff recommends that the Board approve said Tenth Rider to the Agreement; now, therefore, be it
RESOLVED, That the Tenth Rider to the Agreement with the City of Spring Lake Park is hereby approved and that the proper officers of the Board are hereby directed to execute said Tenth Rider to the Agreement on behalf of the Board following approval by the Assistant City Attorney.
