Title

Approving a License Agreement with the Metropolitan Airports Commission for a pedestrian trail across portions of the St. Paul Downtown Airport property.

 

Body

WHEREAS, the City of Saint Paul (“City”) has approved plans to construct, operate and maintain a non-motorized trail for pedestrian and bicycle use, the Robert Piram Regional Trail (the “Trail”) between Harriet Island in Saint Paul and Kaposia Park in South Saint Paul; and

 

WHEREAS, the proposed Trail will serve as an integral part of a trail network, providing both transportation and recreational use, connecting residential areas, regional parks and trail segments that lead into downtown St. Paul; and,

 

WHEREAS, portions of the Trail would be located within property owned or controlled by the Metropolitan Airports Commission ("Commission") at the St. Paul Downtown Airport; and

 

WHEREAS, the Commission has determined that the City’s proposed use would be compatible with the Commission's use of its property as an airport and would not interfere with airport operations, and the Commission is authorized to lease or license its property for compatible uses; and

 

WHEREAS, to authorize the construction and use of the Trail, the Commission requires a License Agreement between the City and the Commission, attached hereto as Exhibit A; and

 

WHEREAS, as a requirement of the License the MAC requires that the City agree to indemnify the MAC; and


WHEREAS, the City Council finds that the construction of the Robert Piram Regional Trail has a legitimate public purpose in providing additional recreational opportunities to the public; and

 

WHEREAS, the expenditure of public funds, which includes the promise of indemnification and defense, will facilitate that public purpose; now, therefore, be it

 

RESOLVED, that the  Council of the City of Saint Paul hereby approve said License Agreement, and authorizes the proper city officials to execute same and any amendments that may be mutually agreed to between the City and the Commission.
