Authorizing an Easement Agreement between the City and St. Paul Port Authority for the Robert Piram Regional Trail.

WHEREAS, on November 22, 2011 the Saint Paul Port Authority of the City of Saint Paul ("Port Authority") granted to the City of Saint Paul ("City") a permanent easement for pedestrian and bicycle trail use, maintenance and repair (the "Original City Easement") for the future Robert Piram Regional Trail (the "Trail") that would connect Harriet Island in Saint Paul and Kaposia Park in South Saint Paul; and/

 

WHEREAS, as planning for the Trail has progressed, the City and Port Authority, in coordination with the Union Pacific Railroad ("UPRR"), have determined that the Trail cannot be constructed within the Original City Easement at grade due to: a) the presence of significant truck traffic along Barge Channel Road that services industrial business in the Port Authority's Southport Terminal Industrial Park; and b) the existence of two separate rail tracks that the Trail would cross at grade; and

 

WHEREAS, the City and Port Authority have developed a plan for the temporary re-routing of the Trail across UPRR tracks in a less active location and across other property owned by the Port Authority, which would provide a safer route for Trail users until such time as a pedestrian/bicycle bridge could be designed, funded and constructed within the Original City Easement and spanning across Barge Channel Road; and said plan has been codified in an easement agreement dedicating a re-routed pedestrian and bicycle trail, attached hereto as Exhibit A ("Easement Agreement"); now, therefore, be it

 

RESOLVED, that the Council of the City of Saint Paul does hereby authorize the proper city officials to execute the Easement Agreement with the Port Authority in a form and content substantially as set forth in Exhibit A attached hereto; and to record said Easement Agreement, if necessary, with the Ramsey County Office of the Recorder and/or Registrar of Titles.
