Approving the release of easement rights retained by Xcel Energy in RES PH 18-202.
Body
WHEREAS, various street and alley rights-of-way were vacated by Saint Paul City Council File RES PH 18-202, approved August 1, 2018, a copy of which is attached hereto ("Vacation Resolution"); and
WHEREAS, Xcel Energy (aka Northern States Power Company) retained easement rights for its electrical service line running across the railroad right-of-way that is part of the Woodward Avenue; and
WHEREAS, BNSF Railway Company ("BNSF"), owns or has interest in the rights-of-way vacated in the Vacation Resolution and property abutting the same; and
WHEREAS, BNSF has requested that the easement rights retained by Xcel Energy be released, and BNSF and Xcel Energy have reached an agreement regarding said release; now, therefore be it
RESOLVED, that with the Certificate of Intended Non-Use, filed voluntarily on behalf of Xcel Energy, the City of Saint Paul hereby releases Xcel Energy's easement rights retained in the Vacation Resolution; and be it further
RESOLVED, that upon passage of this resolution, the proper city officials are hereby authorized and directed to record a copy of same in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificate of Intended Non-Use referenced in this resolution; and be it further
RESOLVED, that all other easements retained in the Vacation Resolution, and all other terms and conditions contained therein shall remain in full force and effect, and to fully incorporate the same into and from the date of this resolution.
