Body
WHEREAS, the Deputy Legislative Hearing Officer conducted a hearing for Black Hart of Saint Paul LLC, d/b/a The Black Hart of Saint Paul, regarding its application for Liquor On Sale - 101-180 Seats, Liquor On Sale - Sunday, Liquor On Sale - 2 AM Closing, Liquor Outdoor Service Area (Sidewalk), Entertainment (B), Gambling Location, and Cigarette/Tobacco licenses on July 2, 2018 and recommended approval,

WHEREAS, City Council accepted and adopted the recommendation of the Hearing officer on July 25, 2018 per RES 18-1161, and

WHEREAS, Chapter 310 of the St. Paul Legislative Code, section 310.04 (d) requires that if an objection to issuance of the license is received within the notification period, the legislative hearing officer shall give notice of the time, place and date of the hearing to the affected neighborhood organization(s) and the applicant; and

WHEREAS, an objection was received and notification of the hearing date, time and place was sent to the applicant and the affected neighborhood organization via the City’s ENS system and posted at stpaul.legistar.com/Calendar.aspx, and,

WHEREAS, Department of Safety and Inspections (DSI) was notified by an objector on August 30, 2018 regarding the status of the hearing for the Black Hart of Saint Paul’s application so that specific concerns may be fully addressed, and

WHEREAS, historically in practice, hearing notifications were also sent to interested parties and in this case, an omission in practice occurred; and

WHEREAS, to provide full transparency to the hearing process, the legislative hearing officer is requesting that the City Council refer this matter back to legislative hearing to allow the objector to be heard on the matter with notification being also sent to all interested parties, including the l...
