Authorizing acceptance of a utility easement from RK Midway Shopping Center, LLC, and RK University Midway, LLC within a portion of the future MSL soccer stadium site.
Body
WHEREAS, a portion of the property owned by RK Midway Shopping Center, LLC and RK University Midway, LLC ("Property Owners") is being developed for a soccer stadium and surrounding streets and amenities; and
WHEREAS, current site conditions are substantially different from what was originally planned such that the stadium developer has redesigned the location of the utilities from the location in the platted Shields Avenue right-of-way; and
WHEREAS, to be consistent with the request by the developer for relocation of proposed utilities from the platted Shields Avenue as was originally proposed, the City of Saint Paul, through its department of Public Works, has determined that a public utility easement ("Easement") is needed to relocate public utilities to within an area between Snelling Avenue on the west and platted Spruce Tree Avenue on the east, which area could eventually be dedicated as street right-of-way as part of an anticipated future extension of Spruce Tree Avenue; and
WHEREAS, the proposed utilities are being installed prior to the street; therefore, a utility easement to the City is required at this time; now, therefore be it
RESOLVED, that the City Council, on behalf of the City of Saint Paul, does hereby accept from the Property Owners the Easement, as documented in Exhibit A attached hereto, and authorizes the proper city officials to record same with the Ramsey County Registrar and/or Recorder's Office.
