Granting a permanent easement for right-of-way purposes to the Minnesota Department of Transportation over a portion of city-owned park land at 270 Lexington Parkway North. (To be withdrawn)

 

Body

WHEREAS, the City of Saint Paul ("City") owns park land at the southeast corner of Lexington Parkway and Rondo Avenue ("Park Property"). The Park Property is maintained by the Department of Parks and Recreation ("Department"); and

 

WHEREAS, the Minnesota Department of Transportation ("MnDOT") is using the subject land to construct ADA compliant sidewalks; and

 

WHEREAS, MnDOT requires 97 square feet of permanent easement and a 125 square foot area for a temporary construction easement that expires 12/1/2021 ; and

 

WHEREAS, MnDOT is offering to purchase said easement for Two Thousand Nine Hundred and 00/100 Dollars ($2,900); and

 

WHEREAS, the Real Estate Manager has determined this to be a fair and reasonable value as determined by an appraisal and agreed to between the City and MnDOT; now, therefore be it

           

RESOLVED, by the Council of the City of Saint Paul, that the proper City officials are hereby authorized and directed to grant a permanent and temporary easement to MnDOT, in a form and content substantially as set forth in Exhibit A attached hereto, and to accept payment for said easement, to be deposited in the proper Department account.
