Body
WHEREAS, the Minnesota Department of Transportation (“MnDOT” or “State”) wishes to cooperate closely with local units of government to coordinate the delivery of transportation services and maximize the efficient delivery of such services at all levels of government; and,

WHEREAS, MnDOT and local governments are authorized by Minnesota Statutes sections 471.59, 174.02, and 161.20, to undertake collaborative efforts for the design, construction, maintenance and operation of state and local roads; and,

WHEREAS, MnDOT and the City have determined the improvements to Smith Avenue/TH149 and Annapolis Street/TH13 are in the best interests of public health, safety and welfare; and,

WHEREAS, the State’s Cost Participation and Maintenance Responsibilities with Local Units of Government Manual addresses the City’s responsibility for certain elements of the project; and,

WHEREAS, the City and the State have come to an agreement regarding the City’s portion of the project cost and maintenance responsibilities; and,

WHEREAS, the City will furnish cabinets, controller, and EVP systems for the signal systems covered under the Agreement, and

WHEREAS, the City funding for the agreement is contained in a resolution in companion Cooperative Construction Agreement #1028296 passed by Council in July, 2018 under Resolution Number 17-969 as contained herein by reference, now
