Title

Amending Council file RES PH 17-300 to say that the State of Minnesota and Minnesota State Colleges and Universities, d/b/a St. Paul College ("Petitioner") is responsible for any and all damages, claims for damages, costs, charges, and expenses related to vacation of the right-of-way within the St. Paul College campus.

Body

WHEREAS, upon the petition of the State of Minnesota and Minnesota State Colleges and Universities, d/b/a St. Paul College ("Petitioner"), as documented in Real Estate Vacation File Number 11-2017, the public property therein described was vacated by St. Paul City Council File RES PH 17-300, approved on October 18, 2017, a copy of which is attached hereto; and

 

WHEREAS, the State of Minnesota Office of the Attorney General, representing the Petitioner, has requested a revision to condition #3 in said RES PH 17-300; so, therefore be it

 

RESOLVED, that condition #3 in said RES PH 17-300 be replaced with the following

 

3.  In lieu if the conditions required under Section 130.05 (2), it is further resolved that Petitioner agrees that upon the granting of this vacation, Petitioner, as the owner of the property, is thus responsible for any and all damages, claims for damages, costs, charges and expenses of every kind and nature from the time of the vacation of the street described in the resolution, according to the laws of the State of Minnesota, and that the City of Saint Paul is hereby forever released from any and all such obligations.

FURTHER RESOLVED, that all other terms and conditions of previously approved said Council File RES PH 17-300 shall remain in full force and effect, from this amendment date.
