Approving the final contract with an LLC comprised of the currently licensed residential trash collectors to provide trash collection to residents of the City of Saint Paul.
Body
WHEREAS, Minnesota Statute § 115A.94, et. seq. authorizes a city to organize trash collection and creates a required procedure a city must follow to organize collection of trash which includes a requirement that a city negotiate with currently licensed residential trash collectors for a minimum of sixty (60) days before considering any other options; and
WHEREAS, in RES 16-1300, the City Council designated August 1, 2016 as the official date to begin the statutorily-required 60-day negotiation period with currently licensed residential trash collectors; and
WHEREAS, after eleven months of preliminary negotiations, on July 26, 2017 in RES 17-203, the City Council authorized City staff to negotiate a final and complete contract with representatives of the existing licensed residential trash collectors; and
WHEREAS, City Staff and the representatives of the existing licensed residential trash collectors have completed final negotiations that have resulted in a final contract, such contract and its attachments are attached hereto; now, therefore, be it
RESOLVED, that the City Council hereby authorizes the execution of the attached contract between the City of Saint Paul and St. Paul Haulers, LLC for the LLC to provide trash collection services and authorizes the proper City officials to execute an agreement with St. Paul Haulers, LLC, which shall be signed by the LLC no later than November 13, 2017.
