Pertaining to an Agreement for Water Service with the City of Minneapolis providing for a connection between the Saint Paul and Minneapolis water systems.
Body
WHEREAS, the Board of Water Commissioners of the City of Saint Paul (“Board”) and the City of Minneapolis (“Minneapolis”) desire a connection between their respective water systems that either party can use to supplement its water supply in the event of an emergency or other limited conditions; and
WHEREAS, such a connection was constructed by the Metropolitan Council inside a buried vault on University Avenue at Emerald Street SE as part of the utility relocation work of its Central Corridor Light Rail Project, the ownership of the vault and its appurtenances was transferred to the Board and the Minneapolis; and
WHEREAS, the parties desire to enter into an agreement that establishes the rights and obligations of the parties with respect to their use and maintenance of the connection; and
WHEREAS, staff has drafted an Agreement for Water Service establishing such rights and obligations and the assistant city attorney has approved said agreement as to form; now, therefore, be it
RESOLVED, that the Agreement for Water Service between the Board of Water Commissioners of the City of Saint Paul and the City of Minneapolis governing the use and maintenance of a connection between the water service systems of the parties is hereby approved, and that the proper officers are hereby authorized and directed to execute said agreement on behalf of the Board.
