Authorizing the appropriate city officials to execute an easement for existing encroachments at 1745 University Avenue, commonly known as Dickerman Park.
Body
WHEREAS, the City owns certain real property commonly known as Dickerman Park; and
WHEREAS, the property adjoining the Park at 1745 University Avenue has window wells, building lighting fixtures, building steps, an access ramp, and a portion of the parking lot serving the 1745 Property which encroach onto the City Property and have for many years; and
WHEREAS, the Department of Parks and Recreation intends to design the Park around existing encroachments at the 1745 University Avenue location given their integral relationship to the function of the building; and
WHEREAS, the building is being sold and as a result of the sale, the property owner and buyer have requested an easement from the City to clarify the status of the encroachments; and
WHEREAS, the easement, a copy of which is attached, permits the existing encroachments to remain unless and until the building is removed but does not give new areas of encroachment; and
WHEREAS, the Parks Commission has considered the matter and their recommendation is attached; now, therefore, be it
RESOLVED, that the appropriate city officials are hereby authorized to execute the attached easement for existing encroachments at 1745 University Avenue.
