Pertaining to MnDOT Agreement No. 1028362 with the State of Minnesota providing for the relocation of a 20-inch water main in conjunction with State Project No. 6223-20 Trunk Highway No. 149 Project.

WHEREAS, the State of Minnesota, acting by and through its Commissioner of Transportation (the “State”) intends to let a contract for State Project No. 6223-20 for reconstruction of Trunk Highway No. 149 Bridge No. 62090 and roadway mill and overlay in Smith Avenue from George Street to West 7th Street in the city of Saint Paul; and
WHEREAS, the Board of Water Commissioners of the City of Saint Paul (the “Board”) owns and operates certain water facilities presently located within the limits of said project; and
WHEREAS, the State has determined that relocation of portions of the Board’s 20-inch water main within the project area is necessary for the construction of said project, and that Minnesota Statutes provide for this relocation work to be accomplished as part of a state highway construction contract; and
WHEREAS, the State prepared Agreement No. 1028362 to provide for reimbursement of said relocation work at an estimated cost of $100,264.81, with final amount to be determined by actual costs; and
WHEREAS, staff has review said agreement and recommends approval; now, therefore, be it
RESOLVED, that Agreement No. 1028362 between the Board of Water Commissioners of the City of Saint Paul and the State of Minnesota pertaining to the relocation of water facilities within State Project No. 6223-20 for reconstruction of Trunk Highway No. 149 Bridge No. 62090 and roadway mill and overlay in Smith Avenue from George Street to West 7th Street in the city of Saint Paul is hereby approved in substantially the form submitted, and that the proper officers are hereby authorized and directed to execute said agreement on behalf of the Board, following approval of the assistant city attorney.
