Title

Authorizing the City to enter into a Cooperative Construction Agreement #1028296 with the Minnesota Department of Transportation (“MnDOT” or “State”) to provide for payment by the City to the State for the design and construction of improvements to, along and adjacent to Trunk Highway No. 149 from George Street to West 7th Street (TH5) according to State prepared plans specifications and special provisions; and to authorize the proper city officials to execute the agreement.

Body

WHEREAS, the Minnesota Department of Transportation (“MnDOT” or “State”) wishes to cooperate closely with local units of government to coordinate the delivery of transportation services and maximize the efficient delivery of such services at all levels of government; and,

WHEREAS, MnDOT and local governments are authorized by Minnesota Statutes sections 471.59, 174.02, and 161.20, to undertake collaborative efforts for the design, construction, maintenance and operation of state and local roads; and,

WHEREAS, MnDOT and the City have determined the improvements to Smith Avenue/TH149 are in the best interests of public health, safety and welfare; and,

WHEREAS, the State’s Cost Participation and Maintenance Responsibilities with Local Units of Government Manual addresses the City’s responsibility for certain elements of the project; and,

WHEREAS, the City and the State have come to an agreement regarding the City’s portion of the project cost and maintenance responsibilities; and

WHEREAS the City’s portion of the project costs rely on funding sources that will not be officially approved until the 2018 capital improvement budget is adopted; and

WHEREAS Public Works will reprioritize resources and make project adjustments needed in order to satisfy the City’s financial obligations under this agreement in the event that the assumed 2018 sources of funding are not approved; now

THEREFORE BE IT RESOLVED, that the City of Saint Paul enter into MnDOT Agreement No. 1028...
