WHEREAS, the City Council adopted RLH SAO 17-30 on May 17, 2017 which granted 1) an extension to May 8, 2017 to remove the mattresses and chair; 2) an extension to June 5, 2017 to remove the rest of the items in the yard except for the wood and lumber; 3) grant an extension to July 10 to remove or properly store lumber and firewood at 541 Case Avenue; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on June 6, 2017 to determine if the owner and/or responsible party abated the nuisance conditions except for the lumber and wood and found these conditions were not abated; and

 

WHEREAS, the owner brought evidence to the Council's Public Hearing on June 21, 2017 that the majority of the abatement was completed and asked the Council for an extension for the construction-related materials, including the flagstone, patio pavers and river rock; and

 

WHEREAS, a Code Enforcement inspector verified on June 28, 2017 the yard is substantially improved from its earlier condition; now, therefore, be it

 

RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is not abated and therefore authorizes the Department of Safety and Inspections to proceed with this nuisance abatement finds that the nuisance conditions are substantially abated, grants that the construction materials may remain through November 1, 2017, orders the removal of all buckets and containers which can accumulate water, and refers the matter for Legislative Hearing November 7, 2017 to determine whether the remainder of the construction materials stored in the yard have been removed.
