Requesting approval of the petition by the City to vacation portions of surplus right-of-way along and near Kellogg Boulevard between West Seventh Street and Washington Street.

BE IT RESOLVED, in accordance with Chapter 130 of the Saint Paul Legislative Code, that upon the petition of the City of Saint Paul ("Petitioner"), as documented in Office of Financial Services Vacation File Number 01-2017, the public property depicted in Exhibit A1 and described in Exhibit A2 attached hereto is hereby vacated and discontinued as public property and, subject to the following conditions, the utility easements within said public property are hereby released in accordance with Section 130.05(3):
1. On behalf of the Department of Public Works of the City of Saint Paul, the release of easement rights shall be subject to and contingent upon recording of the approved Kellogg Center plat.
2. On behalf of the Board of Water Commissioners of the City of Saint Paul, the release of easement rights shall be subject to and contingent upon recording of the approved Kellogg Center plat.
3. On behalf of Northern States Power Company, d.b.a. Xcel Energy, the release of easement rights shall be subject to and contingent upon recording of the approved Kellogg Center plat.
4. Petitioner, its successors and assigns shall, within 60 days of the effective date of this resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution and shall, within the period(s) specified in the terms and conditions of this resolution, comply in all respects with these terms and conditions.
