Approving adverse action against the Auto Repair Garage and Second Hand Dealer - Motor Vehicle licenses held by AAA Enterprises, Inc., d/b/a Affordable Tire at 1118 Seventh Street East.

 

Body

WHEREAS, the Auto Repair Garage and Second Hand Dealer - Motor Vehicle licenses held by AAA Enterprises, Inc. d/b/a Affordable Tire (License ID# 20120004026) for the premises located at 1118-7th Street East in Saint Paul was the subject of a Notice of Violation dated February 23, 2017; and

 

WHEREAS, the Notice listed violations of the approved site plan and license conditions #3, #8, #10, #11 and #19 documented by a DSI Inspector during an inspection of the licensed premises on February 2, 2017; and

 

WHEREAS, based on the fact that this was the second incident of license condition violations within the past twelve (12) months, and the violations are directly related to the licensed activity, per Saint Paul Legislative Codes § 310.05(m) (1), the licensing office recommended a $1,000.00 matrix penalty; and

 

WHEREAS, the licensee did not respond to the Notice of Violation to either pay the $1,000.00 matrix penalty or request a public or administrative hearing; and

 

WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $1,000.00 matrix penalty or request a public or administrative hearing by March 6, 2017, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it

 

RESOLVED, AAA Enterprises, Inc. d/b/a Affordable Tire is hereby ordered to pay a $1,000.00 matrix penalty for violations of the approved site plan and license conditions #3, #8, #10, #11 and #19 documented by a DSI Inspector during an inspection of the licensed premises on February 2, 2017.

 

Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
