Approving adverse action against the Auto Repair Garage and Second Hand Dealer - Motor Vehicle Parts license applications submitted by AAA Enterprise, d/b/a Affordable Tire at 1324 Arcade Street.

WHEREAS, the Auto Repair Garage and Second Hand Dealer - Motor Vehicle Parts license applications submitted by AAA Enterprise d/b/a Affordable Tire (License ID# 20160002655) for the premises located at 1324 Arcade Street in Saint Paul were the subject of a Notice of Intent to Deny Licenses (“Notice”) dated February 10, 2017; and
WHEREAS, the Notice stated that during the application process, DSI reviewed the license history at his current location at 1118-7th Street East and found that he has had three (3) separate adverse actions brought against his licenses between June 13, 2014 and September 29, 2016 for failure to comply with license conditions; and
WHEREAS, there also is a pending adverse action concerning the licensee’s failure to comply with his license conditions; and
WHEREAS, based on the licensee’s continued pattern of failure to comply with the license conditions at his current location, the licensing office recommended denial of his Auto Repair Garage and Second Hand Dealer - Motor Vehicle Parts licenses at the new location; and
WHEREAS, the applicant did not respond to the Notice of Intent to Deny Licenses to request either request a public or administrative hearing; and
WHEREAS, the Notice of Intent to Deny Licenses stated that if the applicant failed to request a public or administrative hearing by February 20, 2017, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Auto Repair Garage and Second Hand Dealer - Motor Vehicle Parts license applications submitted by AAA Enterprises d/b/a Affordable Tire for the premises located at 1324 Arcade Street are hereby denied.
