Approving a Liquor Outdoor Service Area (Sidewalk) license with conditions for New Bohemia St Paul, LLC, d/b/a New Bohemia Wurst & Bier Haus (License ID #20160003866) at 222 Seventh Street West.

Body

WHEREAS, New Bohemia St Paul, LLC d/b/a New Bohemia Wurst & Bier Haus (License ID #20160003866) applied for a Liquor Outdoor Service Area (Sidewalk) license for the premises located at 222 - 7th Street West in Saint Paul; and 

WHEREAS, the licensee also holds an Entertainment (A), Gambling Location,  Liquor On Sale - 101-180 seats, Liquor On Sale - 2 AM Closing and Liquor On Sale - Sunday license; and  

WHEREAS, the premises is located downtown so a petition is not required; and

WHEREAS, the Department of Safety and Inspections received no objections to the issuance of the license; and

WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the license; now, therefore, be it,

RESOLVED, a Liquor Outdoor Service Area (Sidewalk) license is hereby granted to New Bohemia St Paul, LLC d/b/a New Bohemia Wurst & Bier Haus (License ID #20160003866) for the premises located at 222 - 7th Street West in Saint Paul with the following conditions:

1.  Per City of Saint Paul Legislative Code 411.01, the definition of Entertainment A is “Amplified or nonamplified music and/or singing by performers without limitation as to number, and group singing participated in by patrons of the establishment.” (includes karaoke).  Entertainment A license does not allow for patron and/or performance dances.

2.  All doors and/or windows shall remain closed whenever entertainment is provided.

3.  Licensee agrees to limit the placement of seating on the public sidewalk to the area and number of seats shown on the approved Public Works sidewalk seating plan on file with the Department of Safety and Inspections (DSI).

4. Each year prior to the placement of table(s) and/or chair(s) in the public right-of-way (i.e. sidewalk) the licensee agrees to obtain a new Obstruction Permit from the Department of Public Works.  Licensee agrees to maintain the sidewalk café in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective April 1 and expires on October 31 of each year, that table(s) and/or chair(s) may not be placed in the public right-of-way before or after the effective/expiration dates, and that failure to comply with this condition will result in adverse action being taken against all of their licenses.

5.  Licensee agrees to take appropriate action(s) to ensure that the sale, display, and/or consumption of alcoholic beverages is contained within the defined area as per approved sidewalk seating plan on file with DSI.

6.  Any indoor or outdoor activities related to the liquor service areas on either public or private property shall comply with applicable State and Local rules and regulations, including but not limited to Chapter 293 Noise Regulations of the City of Saint Paul Legislative Code.
