Pertaining to Amendment No. 1 to Agreement Number 03012 with the State of Minnesota providing for an increase in Board cost for the removal and disposal of water main on T.H. 5 Bridge No. 9300 between Shepard Road and Fort Snelling.

WHEREAS, on January 14, 2014, the Board of Water Commissioners approved Agency Agreement Number 03012 with the State of Minnesota acting through its Commissioner of Transportation to provide for the reimbursement of State costs related to the removal and disposal of certain abandoned Board facilities as part of the reconstruction of Trunk Highway 5 bridge from Hennepin-Ramsey County line to just south of Edgcumbe Road, State Project No. 6201-86 (the “Agreement”); and
WHEREAS, MnDOT estimated the cost of such work to be $119,070, with final costs to be determined by the actual bid items in the awarded contract; and
WHEREAS, actual bid item costs were higher than estimated and additional water facility removal was found to be necessary on the south end of the bridge, which together resulted in a final actual cost to the Board of $199,094.70, or $80,024.70 higher than the cost of the Agreement; and
WHEREAS, the State has prepared Amendment No. 1 Agreement Number 03012, which provides for said revised total cost to the Board, and the assistant city attorney has approved said Amendment as to form; now, therefore, be it
RESOLVED, that Amendment No. 1 to Agreement Number 03012 between the Board of Water Commissioners of the City of Saint Paul and the State of Minnesota pertaining to revised costs to the Board of $199,094.70 for the removal of water facilities within State Project No. 6201-86 on Trunk Highway 5 from Hennepin-Ramsey County line to just south of Edgcumbe Road in the city of Saint Paul is hereby approved and that the proper officers are hereby authorized and directed to execute said amendment on behalf of the Board.
