Approving adverse action against all licenses held by Payne EZ Market, Inc., d/b/a Payne EZ Market at 1132 Payne Avenue. (Public hearing continued from February 1) (To be withdrawn)

 

Body

WHEREAS, all licenses held by Payne EZ Market, Inc., d/b/a Payne EZ Market (License ID# 20150000195) for the premises located at 1132 Payne Avenue in Saint Paul were the subject of a Notice of Violation dated December 22, 2016, stating the licensee was convicted of Felony Finance Transaction Card Fraud-Trafficking SNAP Benefits (Minn. Stat. § 609.821.1(9) in Ramsey County District Court on November 22, 2016; and

 

WHEREAS, licensee was sentenced for that conviction on January 12, 2017; and 

 

WHEREAS, the conviction was directly related to the licensed activity; therefore, per Saint Paul Legislative Codes § 310.06 (b) (6) (a) and (c) and § 310.06 (b) (8), the licensing office recommended a $1,000.00 matrix penalty; and

 

WHEREAS, the licensee responded to the Notice of Violation to request a public hearing which is scheduled for February 1, 2017; now therefore, be it 

 

RESOLVED, Payne EZ Market, Inc., d/b/a Payne EZ Market is hereby ordered to pay a $1,000.00 matrix penalty as a result of his conviction on November 22, 2016 for Felony Finance Transaction Card Fraud-Trafficking SNAP Benefits (Minn. Stat. § 609.821.1(9).

 

Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
