Approving the release of utility easements at 400 Wabasha Street (Macy’s Site) for The Saint Paul Port Authority.

Body
WHEREAS, the City of Saint Paul ("City") received a request from The Saint Paul Port Authority ("Port") for the release of utility easements located on Port property at 400 Wabasha Street (Macy’s Site). The utility easements requested to be released are an alley vacated July 12, 1961 by Council File No. 202981, recorded as Document Number 1637276 and filed May 25 2001, described and depicted in Exhibit “A” ; also a part of Sixth Street East vacated September 28th, 1962 by Council File Number 209302, recorded as Document Number 450183 and filed November 29th, 1962 described and depicted in Exhibit “B”, and

WHEREAS, the public and private utilities with easements in said vacated right of way have determined that their easement rights may be waived, released and terminated; except that part reserved (5 foot strip) for Northern States Power d/b/a Xcel Energy - Gas and Electric Divisions and described in Exhibit “C”; now, therefore be it

RESOLVED, that with the Certificates of Intended Non-Use, filed voluntarily on behalf of the City of Saint Paul - Public Works; the Saint Paul Regional Water Services; Ever-Green Energy, LLC for District Energy St. Paul, Inc. & District Cooling St. Paul, Inc.; Comcast; Northern States Power d/b/a Xcel Energy - Gas and Electric Divisions; CenturyLink; and Verizon Business (MCI); and made a part hereof by this reference and filed in the Office of Financial Services Real Estate Section; the City, for itself and on behalf of said public and private utilities, hereby waives, releases and terminates said utility easement rights; and be it further

RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee, the proper City officials or the Port are hereby authorized to record a certified copy of this resolution in the office of the Ramsey County Recorder a...
