Approving adverse action against all licenses held by Bennett Restaurant Company, LLC, d/b/a Bennett’s Chop and Railhouse at 1305 Seventh Street West.

 

Body

WHEREAS, all licenses held by Bennett Restaurant Company, LLC d/b/a Bennett’s Chop and Railhouse (License ID #20060002522) for the premises located at 1305 - 7th Street West in Saint Paul were the subject of a Notice of Intent to Suspend Licenses sent September 7, 2016, stating that the Department of Safety and Inspections received information stating that the licensee’s liquor liability insurance was cancelled as of August 10, 2016 due to non-payment of premiums; and

 

WHEREAS, the licensee then submitted a new Liquor Liability Certificate of Insurance on August 12, 2016, with a coverage period from February 12, 2016 to February 12, 2017; and

 

WHEREAS, the new Liquor Liability Certificate of Insurance now showed a six (6) month lapse in liquor liability coverage from August 10, 2015 to February 11, 2016; and 

 

WHEREAS, Saint Paul Legislative Code § 409.065 requires that the licensee hold current liquor liability insurance without a lapse in coverage in order to continue operating the business; and

 

WHEREAS, per Saint Paul Legislative Code § 409.26 (b) (12) the licensing office recommended a ten (10) day suspension of all licenses; and

 

WHEREAS, the licensee responded to the Notice of Intent to Suspend Licenses to request a public hearing which was then scheduled on November 16, 2016; so therefore be it

 

RESOLVED, all licenses held by Bennett Restaurant Company, LLC d/b/a Bennett’s Chop and Railhouse are hereby suspended for a period of ten (10) days due to a six (6) month lapse in liquor liability coverage.  Said suspension will begin at 12 a.m. (midnight) on Wednesday, December 7, 2016 and end at 11:59 p.m. on Friday, December 16, 2016.  Date of said suspension will begin within the next 6 months.  Starting date to be selected by the owners of Bennett’s and communicated to the Department of Safety and Inspections prior to the start date of such suspension.
