Title

Authorizing the Department of Parks and Recreation to enter into an agreement with Chuck and Don's to assume maintenance responsibility of the Lowertown Dog Park.

 

Body

WHEREAS, City owns a parcel of land located at Lowertown Park which is operated as a dog park; and

 

WHEREAS, the dog park is located next to CHS Field, and the Saint Paul Saints have identified a sponsorship opportunity as a means of securing money to fund increased maintenance of the dog park, and are willing to assume maintenance responsibility for the dog park; and

 

WHEREAS, transferring responsibility for the maintneance of the dog park to the Saints will benefit the Parks maintenance staff by freeing time for other responsibilities; and

 

WHEREAS, the Parks and Recreation Department will still be responsibile for the operation of the dog park; and

 

WHEREAS, the City will be indemnified in the event of any accidents, injuries or damages resulting from the maintenance of the property, and the Saints wish to be indemnified in the event of any suits, claims or actions resulting from the operation of the dog park; and

 

WHEREAS, the City Council finds that the maintenance of the dog park is a benefit to the public and that having maintenance performed by the Saints will result in more efficient and improved maitenance of the park; now therefor, be it

 

RESOLVED, that the City Council authorizes the Department of Parks and Recreation to enter into the attached agreement for maintenance of the Lowertown Dog Park, which includes the promise of indemnification.
