Approving adverse action against the Taxicab Driver (Provisional) license application submitted by Andre L. Degeneffe.
Body
WHEREAS, the Taxicab Driver (Provisional) license application submitted by Andre L. Degeneffe (License ID# 20160002264) for the City of Saint Paul was the subject of a Notice of Intent to Deny License dated August 22, 2016, stating the applicant was convicted in Dakota County on March 17, 2015 of Gross Misdemeanor Possession of Burglary or Theft Tools in violation of Minn. Stat. § 609.13, and
WHEREAS, the applicant was placed on Supervised Probation for a period of two (2) years from March 17, 2015 to March 17, 2017; and
WHEREAS, the licensee also pled guilty through a plea agreement and was convicted on October 3, 2014 of Misdemeanor Domestic Abuse - Violate Order for Protection in Ramsey County in violation of Minn. Stat. § 518B.01.14(b); and
WHEREAS, the applicant was placed on Supervised Probation for a period of one (1) year from October 3, 2014 to October 3, 2015; and
WHEREAS, as a result of these convictions, per Saint Paul Legislative Code § 376.16 (e) (4) (a), the licensing office recommended license denial; and
WHEREAS, the applicant did not respond to the Notice of Intent to Deny License to request a public or administrative hearing or withdraw his license application; and
WHEREAS, the Notice of Intent to Deny License stated that if the applicant failed to request a public or administrative hearing or withdraw his license application by September 1, 2016, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Taxicab Driver (Provisional) license application submitted by Andre L. Degeneffe is hereby denied.
