Purpose of Appeal: The inspection states that these items need to be brought up to code and permits filed; however, no remodeling/reworking has been done to trigger such action. Only necessary repairs have/will be made.

Legislative Hearing Staff Comments: Appellant said that inspector left the house this morning and will be back this afternoon to do the inspection. In the meantime, appellant told the inspector he was going to file an appeal. I told the appellant that usually inspections are put on hold after an appeal is filed.

WHEREAS, in the matter of the Appeal of Thomas M. Carbone, Carbone's Pizza, to a Correction Notice-Reinspection Complaint at 680 SEVENTH STREET EAST, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant an extension to September 27, 2016 for compliance of the Correction notice, with exception of Item #2 which has been withdrawn by department; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
