Approving adverse action against the Taxicab Driver license held by Jemal Omer Tahiro.

Body

WHEREAS, the Taxicab Driver license held by Jemal Omer Tahiro (License ID# 20100001850) for the City of Saint Paul was the subject of a Notice of Intent to Revoke License dated June 20, 2016, stating the licensee was cited for 5^th Degree Assault on May 18, 2015 in violation of Minn. Stat. §609.224.1 (Citation #620900266570) for an incident involving the assault of a pregnant female passenger; and

WHEREAS, as the result of an Amended Plea, on February 26, 2016, the licensee was  convicted of Misdemeanor Disorderly Conduct - Offensive/Abusive/Noisy/Obscene in violation of Minn. Stat. § 609.72.1(3) in Ramsey County District Court; and

WHEREAS, the licensee was placed on Probation to the Court for a period of one (1) year from February 26, 2016 to February 26, 2017; and

WHEREAS, based on the fact that the incident occurred while the licensee was operating his taxicab and is therefore directly related to the licensed activity, per Saint Paul Legislative Codes § 376.16 (e) (4) (a) and § 310.06 (b) (6) (c), the licensing office recommended an upward departure to a license revocation; and

WHEREAS, the licensee responded to the Notice of Intent to Revoke License to request a public hearing which was held on July 20, 2016; now therefore, be it 

RESOLVED, the Taxicab Driver license held by Jemal Omer Tahiro is hereby revoked.
