Authorizing the City to enter into a Telecommunications License Agreement with First Bank Building LLC for the Police Department's use of interior and rooftop space in the First Bank building for radio communication equipment.

WHEREAS, since 1953 the City of Saint Paul ("City"), on behalf of the Saint Paul Police Department ("SPPD"), has leased or licensed interior and rooftop space in the First Bank Building located at 332 Minnesota Street (the "Licensed Premises") for the operation of radio communication equipment to serve the SPPD; and
WHEREAS, SPPD wishes to execute a new Telecommunications License Agreement ("License") with First Bank Building LLC, owner of the First Bank Building ("First Bank"), for the continued operation of said radio communication equipment; and
WHEREAS, the License, attached hereto as Exhibit A, provides for a term of five (5) years, with a five-year renewal option, and an annual rent of $4,580.40, to increase each year by the Consumer Price Index; and
WHEREAS, the License requires the City to indemnify First Bank in the event of any damages or injuries caused by SPPD's non-performance, damage to property or negligent use of the Licensed Premises; and
WHEREAS, the City Council finds that said radio communication equipment will serve a legitimate public purpose in assisting SPPD in its efforts to keep the public safe; now, therefore be it
RESOLVED, that the City Council hereby authorizes the proper city officials to execute said License in a form and content substantially as set forth in Exhibit A attached hereto.
