Title

Denying the application submitted by Julie A. Bauch on behalf of 180 East Fifth Street for an exception to the general hours of operation for pedestrian Skyway #26 and Skyway #31.

 

Body

WHEREAS, Julie A. Bauch, submitted an application on behalf of 180 East Fifth Street for an exception to the general hours of operation for the pedestrian skyway system.  That application requests an exception to the general hours of operation for the portion of Skyway #26 and Skyway #31 allowing the building to have the hours of 4:30 a.m. to 10:00 p.m. Monday through Thursday and 5:30 a.m. to 12 midnight on Friday, Saturday and Sunday; and

 

WHEREAS, Chapter 140.11(b) of the Saint Paul Legislative Code gives the Council the power to grant such exceptions; and

 

WHEREAS, 180 Fifth Street is a destination point within the skyway system; and

 

WHEREAS, numerous businesses and residents in the area use the skyway through 180 Fifth Street as an access point to the skyway; and

 

WHEREAS, the Skyway Advisory Committee considered this application and recommended denial of the exception to the general operating hours; and

 

WHEREAS, the Council held a public hearing on the application for the exception on April 20, 2016 at which time the Council heard the recommendation from the Department of Safety and Inspections to deny and public testimony was allowed; now, therefore, be it

 

RESOLVED, that the Council hereby finds that there is not a sufficient basis for the proposed hours of operation for the above-stated reasons and denies the application for alternate hours. 

 

A copy of this resolution, as adopted, shall be sent by first class mail to the applicant.
