Waiving the 45-day notice requirement in order to issue a Liquor On Sale -101-180 Seats, a Liquor On Sale - Sunday and an Entertainment A license with conditions to the existing Liquor-Outdoor Service Area (Patio) license held by Destiny Café 2 Corp d/b/a Destiny Café 2 Corp (License ID #20100004767) for the premises located at 1151 Clarence Street.

WHEREAS, Destiny Café 2 Corp d/b/a Destiny Café 2 Corp (License ID #20100004767) applied for an upgrade in order to add a Liquor On Sale -101-180 Seats, a Liquor On Sale - Sunday and an Entertainment A license to their existing Liquor-Outdoor Service Area (Patio) license for the premises located at 1151 Clarence Street; and
WHEREAS, the licensee currently holds a Wine On Sale, a Malt On Sale (Strong) license which would be cancelled upon issuance of the full liquor on-sale licenses; and
WHEREAS, the Department of Safety and Inspections received a letter from the District 2 Community Council in support of the license applications and waiving the 45-day notice requirement; and
WHEREAS, the Department of Safety and Inspections received no other objections to the issuance of the licenses; and
WHEREAS, the Council finds that the application is in order and there are no grounds for denial of a Liquor On Sale -101-180 Seats, a Liquor On Sale - Sunday and an Entertainment A license; now, therefore, be it,
RESOLVED, a Liquor On Sale -101-180 Seats, a Liquor On Sale - Sunday and an Entertainment A license are hereby granted to Destiny Café 2 Corp d/b/a Destiny Café 2 Corp (License ID #20100004767) for the premises located at 1151 Clarence Street in Saint Paul with the following conditions:
1. Licensee agrees to operate the establishment in compliance with Section 409.02 of the City of Saint Paul Legislative Code as a “Restaurant.”
