Title

Authorizing an amendment to the agreement with Bench Strength Partners, Inc. (BSP) for BSP's professional services in the negotiation of contracts for rental of space by cellular communication carriers on city park property and within city right-of-way.

 

Body

WHEREAS, on January 13, 2016 the City Council adopted RES 16-108 to authorize the City to enter into a Representation Agreement ("Agreement") with Bench Strength Partners, Inc. ("BSP") for BSP's services in negotiating favorable lease, license or other agreements ("Contracts") on behalf of the City of Saint Paul ("City") with cellular communications companies ("Carriers") for the placement and operation of cellular antennas and related equipment on city park property, and on January 26, 2016 the City and BSP entered into said Agreement; and

 

WHEREAS, the City recently has received requests from Carriers for the installation of small cell communication systems ("Small Cell Systems") within city right-of-way and city property managed by the Department of Public Works ("Public Works"); and

 

WHEREAS, the City and BSP wish to amend the Agreement to expand its scope to include BSP's negotiation of leases, licenses, lease buyouts or other agreements for the rental of space within certain city right-of-way or upon other city property managed by Public Works for the installation of Small Cell Systems, including cellular antennas and other related communication equipment in or on light poles, traffic control poles, conduits, conductor pull boxes and other equipment; now, therefore be it

 

RESOLVED, that the proper city officials are hereby authorized, subject to approval by the city attorney, to enter into a First Amendment to Representation Agreement, as set forth in Exhibit A attached hereto, for BSP's professional services with respect to Small Cell Systems; and be it further

 

RESOLVED, that in all other respects the Agreement, as previously executed, shall remain in full force and effect.
