Approving adverse action against the Cigarette/Tobacco license held by Liquor Liquidator, Inc., d/b/a Liquor Liquidator located at 1047 Hudson Road in Saint Paul.

WHEREAS, the Cigarette/Tobacco license held by Liquor Liquidator, Inc., d/b/a Liquor Liquidator (License ID #20110000325) for the premises located at 1047 Hudson Road in Saint Paul, was the subject of a Notice of Violation dated August 26, 2015, stating an employee of the licensee sold tobacco products to an underage person on August 13, 2015 in violation of Minn. Stat. § 609.685 and Saint Paul Legislative Code § 342.07(c); and
WHEREAS, this was the third violation for the sale of tobacco products to an underage person within the past eighteen (18) months; and
WHEREAS, per Saint Paul Legislative Code §324.11 (b) (1), the licensing office recommended an $800.00 matrix penalty and a seven (7) suspension of the licensee’s Cigarette/Tobacco license; and
WHEREAS, licensee did respond to the Notice of Violation to admit to the violation and accept DSI’s recommendation of an $800.00 matrix penalty and seven (7) suspension of his Cigarette/Tobacco license; and
WHEREAS, the licensee paid the $800.00 matrix penalty on September 11, 2015; now, therefore, be it
RESOLVED, the Cigarette/Tobacco license held by Liquor Liquidator, Inc., d/b/a Liquor Liquidator is hereby suspended for seven (7) days. Said suspension will begin at 12:00 midnight on Wednesday, October 14, 2015 and end at 11:59 p.m. on Tuesday, October 20, 2015.
