Approving adverse action against all licenses held by B H & M, Inc. d/b/a Born’s Dutch Bar located at 899 Rice Street in Saint Paul.

WHEREAS, all licenses held by B H & M, Inc. d/b/a Born’s Dutch Bar (License ID #0016222) for the premises located at 899 Rice Street in Saint Paul, were the subject of a Notice of Violation dated June 25, 2015, stating the licensee submitted a certificate of liquor liability insurance to the Department of Safety and Inspections showing a lapse in coverage from April 30, 2015 to June 16, 2015; and
WHEREAS, per Saint Paul Legislative Code § 409.26 (b) (12) the licensee is required to maintain current liquor liability insurance without a lapse in coverage in order to continue operating his business; and
WHEREAS, per Saint Paul Legislative Code § 409.26 (b) (12), a first violation for a lapse in liquor liability insurance is a ten (10) day suspension of all licenses; and
WHEREAS, the licensee responded to the Notice of Violation to request a public hearing which was held on August 5, 2015; now therefore be it
RESOLVED, all licenses held by B H & M, Inc. d/b/a Born’s Dutch Bar are hereby suspended for ten (10) days. Said suspension will begin at 12:00 midnight on Wednesday, August 26, 2015 and end at 11:59 p.m. on Friday, September 4, 2015.
