Approving the application of Xcel Energy for a sound level variance for construction work related to the 2015 East Metro Pipeline Replacement Project, with the sound source at the intersection of St. Albans Street and Central Avenue, Monday through Saturday only, from July 31, 2015 to August 22, 2015.
Body
WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and
WHEREAS, §293.09 provides for the granting of variances from the sound level limitations contained in §293.07, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on the applicant, other persons or on the community; and
WHEREAS, Xcel Energy, represented by Tony Wendland, Project Manager, who has been designated as the responsible person on the application, has applied for a variance, with a sound level request at 88 dB at 7 meters, for construction work related to the 2015 East Metro Pipeline Replacement Project, with the sound source at the intersection of St. Albans Street and Central Avenue, Monday through Saturday only, from July 31, 2015 to August 22, 2015; and
WHEREAS, in order to meet required completion dates and to minimize disruption to businesses, the public and adjoining property owners, the applicant is seeking a variance from July 31, 2015 to August 22, 2015, Monday through Saturday only; and
WHEREAS, if applicant is not granted a variance, applicant will not be able to operate general construction/demolition equipment, including a Horizontal Directional Drilling Guide (HDD) bore rig and support equipment, such as an excavator and mud machine to do the needed pipeline replacement project, to bore a section of pipeline under Hwy 94, and sound source at the intersection of St. Albans Street and Central Avenue; and
