Waiving the 45-day notice requirement to add a Liquor - Outdoor Service Area (Sidewalk) license to the existing Liquor On Sale - 100 seats or less and Liquor On Sale - Sunday licenses held by Tongue In Cheek, LLC, d/b/a Tongue In Cheek (License ID #20140000653) at 987 Payne Avenue.

Body
WHEREAS, Tongue In Cheek, LLC d/b/a Tongue In Cheek (License ID #20140000653) applied for a Liquor - Outdoor Service Area (Sidewalk) license for the premises located at 987 Payne Avenue in Saint Paul; and

WHEREAS, the licensee currently holds a Liquor On Sale - 100 seats or less and a Liquor On Sale - Sunday license; and

WHEREAS, DSI was able to verify that the licensee obtained nine (9) of fifteen (15) possible signatures for sixty (60) percent support of the petition required for a Liquor -Outdoor Service Area (Sidewalk) license; and

WHEREAS, the Payne Phalen District Five Planning Council sent a letter to DSI in support of the 45-day waiver to add a Liquor - Outdoor Service Area (Sidewalk) license; and

WHEREAS, the Council finds that the application is in order and there are no grounds for denial of a Liquor- Outdoor Service Area (Sidewalk) license now, therefore, be it,

RESOLVED, that a Liquor - Outdoor Service Area (Sidewalk) license is hereby granted to Tongue In Cheek, LLC d/b/a Tongue In Cheek (License ID #20140000653) for the premises located at 987 Payne Avenue in Saint Paul with the following added license conditions:

3. Sidewalk seating approved for a maximum of eighteen (18) seats.

4. Each year prior to the placement of table(s) and/or chairs(s) in the public right-of-way (i.e., sidewalk), the licensee agrees to obtain a new Obstruction Permit from the Department of Public Works. License agrees to maintain the sidewalk cafe in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective on April 1 and expires on October 31 of each year, that table(s) and/or chair(s) may not be...
