Requesting a variance from the Minnesota Department of Transportation Standards for State Aid Operations for the Payne Avenue reconstruction from Orange Avenue to Hoyt Avenue. (Project No. S.A.P. 164-179-016)

WHEREAS, the City of Saint Paul Department of Public Works awarded a contract and reconstructed Payne Avenue (MSAS 179) from Orange Avenue to Hoyt Avenue within the City which included new pavement, curb & gutter, sidewalks, sewer facilities, street lighting, boulevards and landscaping, and  
 
WHEREAS, Minnesota Rules for State Aid Operations 8820.2800 Construction Requirements, Subpart 2A. Eligibility for Funding, requires that:
"Plans and estimates for each state-aid construction project must be submitted for review.  Each plan must show the subsequent stages required for the completion of the improvement, portions of which may be covered by later contracts or agreements.  Only those projects for which final plans are approved by the state-aid engineer before opening bids are eligible for state-aid construction fundsÂ…", and
WHEREAS, the City planned to use local funds for the improvements along Payne Avenue (MSAS 179) but soil contamination found on the project caused the City to spend all of its available local funds on site remediation efforts, so
 
THEREFORE BE IT RESOLVED, that the Council of the City of Saint Paul hereby requests a variance from Minnesota Department of Transportation State Aid Operations Rules Chapter 8820.2800 Construction Requirements, Subpart 2A. Eligibility for Funding, that will allow the City to submit plans and estimates for state-aid engineer approval after the bids have been opened and the project constructed in order for the City to use state-aid construction funds for the Payne Avenue (MSAS 179) improvements.
