Approving adverse action against the Cigarette/Tobacco license and Alarm Permit (New) held by West Side Groceries, Inc., d/b/a West Side Groceries located at 605 Stryker Avenue.

WHEREAS, the Cigarette/Tobacco license and Alarm Permit (New) held by West Side Groceries, Inc., d/b/a West Side Groceries (License ID #20110000823) for the premises located at 605 Stryker Avenue in Saint Paul, were the subject of a Notice of Intent to Revoke License & Permit dated January 7, 2015, stating on December 8, 2014, the licensee entered an Amended Plea in Ramsey County District Court to Felony Assault - 2nd Degree-Dangerous Weapon in violation of Minn. Stat. § 609.222.1; and
WHEREAS, on December 15, 2014, the licensee pled guilty in Ramsey County District Court to Gross Misdemeanor Food Handler - License Required in violation of Minn. Stat. § 28A.04.1(a);
WHEREAS, based on this information, per Saint Paul Legislative Code § 310.06 (b) (6) (a) and (c) and Saint Paul Legislative Code § 310.06 (b) (6) (8), the licensing office recommended revocation of the Cigarette/Tobacco license and Alarm Permit (New); and
WHEREAS, the licensee did not respond to the Notice of Intent to Revoke License & Permit to request a public or administrative hearing; and
WHEREAS, the Notice of Intent to Revoke License & Permit stated that if the licensee failed to request a public or administrative hearing by January 19, 2015, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Cigarette/Tobacco license and Alarm Permit (New) held by West Side Groceries, Inc., d/b/a West Side Groceries are hereby revoked.
