Approving adverse action against the Second Hand Dealer (Antiques) license held by Theodore Smebakken, d/b/a Peter's Oldies But Goodies at 1814 Selby Avenue.

WHEREAS, the Second Hand Dealer (Antiques) license held by Theodore Smebakken d/b/a Peter's Oldies But Goodies (License ID #0083897) for the premises located at 1814 Selby Avenue in Saint Paul, was the subject of a Notice of Intent to Suspend License dated January 8, 2015, stating the licensee failed to pay delinquent license and late fees and submit required information to maintain the license; and
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and
WHEREAS, the licensee did not respond to the Notice of Intent to Suspend License to pay the delinquent license and late fees and submit required information or request a hearing; and
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to pay the delinquent license and late fees and submit the required information or request a hearing by January 19, 2015, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Second Hand Dealer (Antiques) license held by Theodore Smebakken d/b/a Peter's Oldies But Goodies is hereby suspended for failure to pay delinquent license and late fees.
FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit required information in order to maintain the license.
The license will remain suspended until all license fees and penalties are paid in full and all required information is submitted to the Department of Safety and Inspections.
