Authorizing the Department of Parks and Recreation to enter into a contract with, and provide indemnification for, Portable Barge for up to $60,000 of FEMA flood reimbursable funds to provide dredging activities at the Public Dock.
 
Body
WHEREAS, the City of Saint Paul, through its Department of Parks and Recreation, wishes to contract with Portable Barge to dredge underneath the Public Dock at Harriet Island; and
WHEREAS, in order to dredge, Portable Barge will remove half the dock and swing the rest out to allow room for equipment to access and remove trees wedged under the dock as well as silt buildup; and
WHEREAS, Portable Barge requires that it be held harmless for any damages or injuries caused to the Public Dock as a result of the dredging activities except to the extent that such damages or injuries are the result of negligent acts or omissions by Portable Barge, it officers, employees or agents; and
WHEREAS, dredging at the Public Dock is necessary to clear encumbrances which are hazardous to boat traffic, and the promise of indemnification will enable the Department of Parks and Recreation to contract with Portable Barge to perform the work; now, therefore, be it
RESOLVED, that the Saint Paul City Council agrees  to authorizie the Department of Parks and Recreation to enter into a contract with Portable Barge for up to $60,000 of FEMA flood reimbursable funds to provide dredging activities at the Public Dock.
BE IT FURTHER RESOLVED, that the Saint Paul City Council agrees to indemnify and hold harmless Portable Barge for any damages or injuries caused to the Public Dock as a result of the dredging activities except to the extent that such damages or injuries are the result of negligent acts or omissions by Portable Barge, it officers, employees or agents.
